ALL OF THE MEMBERSHIP RULES AND TERMS AND CONDITIONS CONTAINED HEREIN APPLY EQUALLY TO MEMBERS, TEMPORARY MEMBERS AND GUESTS ALIKE THE GYM & FACILITIES All reference to the “Gym” refers to , Empower Fitness Carlow R93 P660 , its staff, employees, sub-contractors, agents and representatives.

All reference to the “Facilities” refers to the Gym, showers, changing rooms and fitness studios as available to the member (where applicable).

Members of the Gym are bound, as a condition of membership, to comply with the rules set out herein. This is to ensure that the Facilities are properly and safely used and that all Members have full advantage of them without interfering with the enjoyment of others.

Under no circumstances are members to contact members of Empower Fitness on their personal phones, social media or email. It is company policy that members respect our staff privacy. We ask you direct any queries or questions you have may have to our company email info@empowerfitness.ie or phone 087 738 2955 where a member of the Empower fitness will deal with it.

By downloading the Glofox app, you agree to all of our terms and conditions.
If you require an induction, you must contact a member of staff before beginning any training.
The gym floor will be supervised at all times. If you are not training correctly, our staff will assist you with proper technique to help reduce the risk of injury.
If you are unsure how to use any equipment, please speak to a member of staff before attempting to use it.
If you have any health issues or injuries, you must inform us so we can document them electronically on your profile.

When using Empower Fitness Carlow services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time. You agree that you are at least 16 years old and that if you are between 16 years and 18 years old, your legal guardian has reviewed and agrees to these terms and is happy for you to access and/or use our Services. We reserve the right, from time to time, with or without notice, to change these Terms at our sole discretion, and the latest version will appear on our website, with the date that it was last updated. By using the Service after any changes have been posted, you agree to the new terms.

PRINCIPLE TERMS

1. This agreement between you and the Gym (“Agreement”) commences either: a. If you are on the Gym’s premises, once you have indicated your acceptance in the Declaration section of this website (“Website”) sign up process; OR b. If you are not on the Gym’s premises, once you have indicated your acceptance in the Declaration section of Website sign up process and then either entered the Gym’s premises or after a period of 7 days has elapsed, whichever is earlier.

By accepting our terms and conditions you are in agreement with our ‘Gym Member Policy and agree to uphold and adhere to Empower Fitness member policies. 

2. Your membership starts immediately upon indicating your acceptance in the Declaration section of Website sign up process. You will be entitled to all the rights and privileges exercisable for the Type of Membership you have chosen. FEES AND CHARGES

3. The initial payment is due from you and is payable immediately and is not refundable other than in the event of breach or negligence by the Gym.

4. You hereby consent to a recurring monthly Direct Debit payment (which represents a month advance payment for that month’s membership). You acknowledge that this recurring Debit Direct will continue to apply until you cancel your membership pursuant to these terms and conditions. You are obligated to make every Direct Debit Payment every month regardless of non-attendance, except where the cancellation terms below are met.

5. Under no circumstances can anyone under the age of 16 train in the gym or do classes, with or without a guardian.

6. If you fail to pay any amount due under this Agreement for a period of more than thirty days, then we may pass the debt to a third party company for collection. The reasonable and direct costs incurred in employing the third party company will be borne by you including costs in tracing you if you have changed your address without telling us. AUTOMATIC RENEWAL

7. We will automatically continue collecting the Direct Debit payment amount every month. Your membership will be extended by one month for each Direct Debit payment you make (“Renewal Period”).

8. You may prevent the Renewal Period by cancelling your membership by email 1 week before your payment date.

PAUSING YOUR MEMBERSHIP

9(1). Any paused membership can only be paused for up to 3 months at a time – the membership will automatically restart unless we are informed in writing otherwise to cancel before the paused period ends.

9(3). You agree that by requesting us to pause your membership it will restart at the membership rate that was in effect prior to pausing. any increase in membership will not be applicable to your account during a pause period.

CANCELLATION

10. You may cancel your membership at any time by email only. You expressly acknowledge that it remains your responsibility to cancel your own membership. You expressly acknowledge that you cannot cancel your by any other means than by email. Any purported membership cancellation by verbal or other means does not constitute cancellation of your membership.

11. You expressly acknowledge that if you do not cancel your membership before the end of your next renewal period you will not be entitled to any refund. No refunds can be issued for any membership taken before receipt of email confirmation of cancellation. Members need to request their membership to be cancelled  1 week before their payment date. Please email info@empowerfitness.ie from your membership account email only requesting cancellation of your membership. Using the contact us section does not secure the cancellation request as for security reasons the cancellation request must come directly from your email only.

12. Where a member has cancelled their monthly membership in writing with Empower fitness Carlow and wishes to reactivate their membership at a later time we wish to advise that the membership fee and/or subscription fee is subject to the monetary amount in effect at that time.  Empower fitness and health ltd has the right to refuse any admission or refuse to reinstatement any membership in breach of our terms and conditions. You acknowledge that once you cancel your membership you will be required to pay the admin fee to reactivate it regardless of when you cancelled your membership.

REFUNDS

13. We do not issue refunds all memberships that are processed and paid by members are full and final. This applies strictly to all Annual memberships in particular where we are not required to issue refunds once payment is processed.

14. The Gym may terminate this Agreement with immediate effect on notifying you if you are in breach of this Agreement and/or Gym Rules (as defined).

LOCKERS

15. Lockers are provided in all gyms. Please ensure that you lock all belongings away securely at ALL Times! Management is not responsible for the loss or theft of any items whilst on the premises.

16. Lockers are only for the time you are in the gym and are not allowed for overnight use.

SOCIAL MEDIA COMPETITIONS TERMS AND CONDITIONS

17. Competitions are open to Republic of Ireland residents only.

18. The closing date will be published in the social media post and entries must be submitted before this date. Entries submitted after the final closing date will not be included.

19. Prize(s) will be described in the social media post and is non-transferable.

20. There is no cash or prize alternative. In the event of cancellations, there will be no refund of the value of the prize.

21. By participating in Empower fitess social media competitions, you agree to be bound by the competition terms and conditions.

22. The rules of the competition will be fully described in the social media post and the winner will be contacted by social media (through private message or reply to the competition entry).

BICYCLES

23. Use of these bike racks is at your own Risk. Security of your bicycle is your responsibility. Please ensure your bicycle is securely locked at all times. Management accepts no responsibility for the loss or theft of your bicycle or any items linked to your bicycle whilst in or close to Empower GYM premises.

GENERAL TERMS

24. You agree to comply with Membership Notices (“Rules”) which are displayed in the Gym and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time.

25. The Gym will be opened between the hours as displayed in the Gym. The Gym may in its absolute and sole discretion vary these opening days and times by providing notice to the members. Such notice will be displayed and made clearly visible in the Gym. The Gym will we closed on all public holidays and bank holidays unless otherwise indicated by management which shall be at the absolute and sole discretion of management.

26. You agree to ensure appropriate attire (including covered footwear) will be worn while on the Gym premises and you will use a towel at all times whilst in the Gym and using the Facilities.

27. You agree that all weights and equipment must be put back after use.

28. You agree and acknowledge that that no smoking, alcohol or food is permitted in the Gym.

29. You agree that Gym management reserves the right to refuse entry, cancel a membership or request a member leave the premises if you do not behave in a responsible manner, if you are under the influence of drugs and/or alcohol or you do not adhere to this Agreement and/or Rules.

30. You agree to promptly report to Gym management any disrespectful or poor behaviour from other members or Gym staff.

31. You acknowledge that the Gym takes no responsibility for any member’s lost or stolen equipment or possessions, which remains at your sole risk.

32. You agree to report to Gym management all faults or damage to Gym equipment or Facilities.

33. You agree and acknowledge that the Gym and Facilities may be unavailable at any particular time due to mechanical breakdown, equipment servicing, fire, catastrophe or any other unforeseen reason. The Gym will not be held responsible or liable for such occurrences.

34. You agree (at your own cost and expense) to obtain medical evaluation, clearance and judgement from a doctor before undertaking any strenuous exercise in the Gym. You agree to promptly inform Gym management in writing, of any and all medical illnesses which may be detrimental to your health if undertaken in conjunction with the Gym equipment or training programme/s.

35. The validity, construction and performance of this Agreement shall be governed by Irish law.

FILMING AND VIDEO

36. Please be aware that we operate a strict policy that filming or photography in the gym where permitted MUST NOT include any member or person in the background.

37. It is any member’s right to request that they are not to be included in any footage by a third party.

38. You can where applicable obtain in writing and confirm with management that a member has given approval to being in the background of any footage or photograph but this must be signed by all parties involved.

39. Existing members must give 30 days’ notice that they intend to change their membership package.
If no such changes are communicated prior to the renewal date, the terms of this Agreement will apply until the next anniversary of your membership.

ANNUAL MEMBERSHIPS

40.The annual membership is a one-time payment that runs for a year. Members must make a new purchase once their previous one expires at the current year’s price.

THIRD PARTY COACHING AND TRAINING

41. You expressly acknowledge that you are not permitted to coach any person in the gym or online inside the premises.

42. There is no third party coaching, training, rehabilitation or any activity to constitutes any activity to establishes a commercial relationship within Empower Fitness

43. A legal licence agreement is required for any third party coach to ensure there is a commercial agreement in place before any coaching can begin.

44. You must have a valid insurance policy in place before commencing any coaching.

45. You must present valid and relevant qualifications before any agreement is in force.

CAR PARKING

We are not responsible for any personal belongings left inside vehicles parked in our facilities. Customers are advised to ensure that all valuables are removed from their vehicles before leaving them in our parking area.

Additionally, we assume no liability for any damage, theft, loss, or mechanical issues that may occur while the vehicle is parked in our facility. Parking is at the sole risk of the vehicle owner, and we do not provide surveillance or security guarantees.

PRIVACY

47. YOU ACKNOWLEDGE THAT USE THE EMPOWER FITNESS AND HEALTH LIMITED WEBSITE/APP IS SUBJECT TO THE PRIVACY POLICY AS THEREIN PUBLISHED.

48. FOR THE PURPOSES OF DATA PROTECTION LEGISLATION YOU CONSENT TO THE COLLECTION AND PROCESSING OF ALL OR ANY PERSONAL DATA AND YOUR PHOTOGRAPHIC / PHYSICAL IMAGE (IN MANUAL, ELECTRONIC, PICTORIAL, VIDEO OR ANY OTHER FORM) WHILE ON THE GYM PREMISES. COLLECTION AND PROCESSING INCLUDES BUT IS NOT LIMITED TO OBTAINING, RECORDING, PHOTOGRAPHING, USING AND HOLDING DATA AS IT RELATES TO YOU WHILE ON THE GYM PREMISES. THE GYM COLLECTS AND PROCESSES SUCH DATA (INCLUDING YOUR PERSONAL DATA) FOR THE PURPOSES OF ENSURING THE HEALTH AND SAFETY OF ALL GYM MEMBERS AND TO EFFECTIVELY MANAGE, OVERSEE AND PROMOTE THE GYM AND ITS FACILITIES.
